A BILL to amend article three, chapter nine of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section four-a,
relating to eligibility for assistance.
Be it enacted by the Legislature of West Virginia:
That article three, chapter nine of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
four-a to read as follows:
ARTICLE 3. APPLICATION FOR AND GRANTING OF ASSISTANCE.
§9-3-4a. Eligibility for assistance.
Notwithstanding any other provision of this code to the contrary, no person who is otherwise eligible to receive
financial assistance for the support of dependent children may
receive such assistance unless that person has actual physical
custody of the dependent child or children and that person
provides all information known to him or her and cooperates with
the division in identifying or locating the absent responsible
person.
NOTE: The purpose of this bill is to condition eligibility
for AFDC assistance on the recipient's having physical custody of
the dependent child or children and to require that any such
recipient cooperate with the division and provide information to
help identify or locate the absent responsible person.
§9-3-4a is new; therefore, strike-throughs and underscoring
have been omitted.
